How to transfer a foreign domestic helper (maid) in Malaysia to your employment

Thinking of transferring your current helper or hiring a helper who is currently still legally working with another employer? Different helper transfer conditions will apply depending on whether you’re hiring as a Malaysian or Expatriate employer. The criteria are listed below:
Expatriate Employers who are Employment Pass (EP) or Residence-Talent Pass (RP-T) Holders
In order for a domestic helper hired by an Expatriate employer on an EP or RP-T to be legally transferred, the following conditions must be met:
- Worker is 21-45 years old, with no restriction on her length of time working with her current employer in Malaysia
- Worker must possess a legal work permit that is valid at the point of her intended job transfer in Malaysia
- Worker’s current and new employer must both be Expatriates on an EP or RP-T
- Worker’s current employer must be cooperative to the transfer and agrees to sign the relevant Immigration transfer paperwork
Local Malaysian Employers
In order for a domestic helper hired by a Malaysian employer to be legally transferred, the following conditions must be met:
- Worker is 21-45 years old, and must have worked for less than 1 year with her current employer in Malaysia
- Worker must possess a legal work permit that is valid and still within her 1st permit year at the point of her intended job transfer in Malaysia
- Worker’s current and new employer must both be Malaysians
- Worker’s current employer must be cooperative to the transfer and agrees to sign the relevant Immigration transfer paperwork in person at the Immigration Office
Kindly note: the Immigration Department makes some case exceptions for the transfer requirements/ restrictions, especially in situations of a worker transfer between family members or spouses.
